The 5th Amendment

Should reading the US Constitution and the Bill of Rights ... before each election cycle, be required to vote?
Here is an internet summary of the 5th Amendment:
  • No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; 
  • nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; 
  • nor shall be compelled in any criminal case to be a witness against himself, 
  • nor be deprived of life, liberty, or property, without due process of law; 
  • nor shall private property be taken for public use, without just compensation.

THE 5TH AMENDMENT

smart criminals

A lot of criminals think they are smarter than the police and can get away with their crimes. Okay, there are certain criminals that are smarter than certain cops.
But anonymity is more of an asset to criminals than their IQs.

In fact, the smartest parts of a crime involve creating anonymity: 
> stealth in execution 
> untraceability in approach, withdrawal and after-life.

But criminals underestimate the power of the combined intelligence
of law enforcement teams - working together to penetrate and decode the forcefield
of a criminal's anonymity.
And part of Police IQ is the years of experience in dealing with criminals - the cumulative knowledge of millennia of solving crimes - be they high crimes or petty offences.

And the police must fight mesireh to solve many crimes - this is when locals won't tell on the criminals in their midst. When minorities choose to stick together in the midst of crime- 
for the sake of presenting a unified culture.

THE 5TH AMENDMENT

Presidential Pardons

US Presidents can pardon Federal crimes.
State Governors can pardon State crimes.

These pardons can either correct an injustice or create a new injustice.

That aside, I believe that both US Presidents and State Governors
should be able to: 
> order a new trial for a convicted person,
> automatically bar the former presiding judge from the trial
> and the Government can insert a 'friend of justice' into the trial
   to act as a third party (equal in power to the prosecuting and defense attorneys)
   in the trial to insure a fair and Constitutional trial where it is evident 
  that the former trial was kangaroo-ed.
> The judge must allow any evidence that the 'friend of justice' presents.
